window with a boom box 30 minutes before the alarm. oh, man. the precious last 30 minutes. here's a look right now at the kpix 5 roof camera. you can see the clouds right there behind the transamerica pyramid. so not covering the top. you can see the red light at the top of the pyramid. your headlines today, yes, we are warming up a bit. we'll sigh more sunshine as well today and really going to heat up tomorrow and the weekend. it's going to be warm all across the state of california. now, all across the bay area we are looking at cloud coverage and some locations getting a break. so when the daylight comes it may not be as gray and gloomy as what we saw yesterday. visibility wise is okay. half moon bay six miles. the fog won't affect your commute because it's not too low. wind speeds will contribute to keeping temperatures by the water fairly comfortable in

the 50s, 60s, maybe some in the low 70s right around places like san francisco and oakland. but inland communities that onshore breeze not going to affect you too much because it's not as strong today. jaclyn. heads up for anyone who was thinking about using mass transit this morning. right now bart is experiencing systemwide delays. this is all due to an equipment problem on the track in downtown oakland. we also have some emergency track repairs between bay fair and hayward stations. so just plan accordingly. we'll keep you posted. right now 205 definitely seeing the usual slowdowns. 21 minutes to 580. 580 in the yellow 30 minutes to 680. a man is set to be arraigned today in connection with a deadly accident on 80 in fairfield. chp officer and another driver were killed in the crash and

anne makovec is in the newsroom with more. reporter: two counts of gross vehicular manslaughter. that's what shawn walker is facing. he is a 36-year-old man from rocklin and he is going to be in court for the first time today. officers believe walker was driving recklessly speeding and was distracted by his phone. the crash happened friday morning in fairfield killing a california highway patrol motorcycle officer 46-year-old kirk griess, and 49-year-old jaime manuel. manuel was driving an suv when offiie pover on 80 near manuel campos parkway. that's when officers say walker's pickup truck veered off the highway and hit both of them. they called the crash entirely preventable. >> we want the message to be sent that your actions have consequences, that answering a phone or sending or answering a text can result in the tragic consequences that we witnessed this last week. >> reporter: the chp officer was a 19-year veteran of the

force. and we have been hearing from some of the friends of jaime manuel whom they call jim. more from them in the next half-hour. walker was sent to the hospital after the crash and was released. he will be arraigned at 1:30 this afternoon in solano county superior court in fairfield. anne makevoc, kpix 5. right now, the search is on for a suspect who police say sexually assaulted a woman who hailed a rideshare. on your left is a sketch of the man. police found the victim on fashion island boulevard in san mateo tuesday night. investigators are being very vague about where the woman was picked up by a rideshare company, only saying it was near highway 92 in san mateo. the victim was able to escape with the help of a passerby who saw the assault happen. this morning, new accusations in the death of a construction worker in the twin peaks tunnel. kpix 5's jackie ward in san francisco this morning with new questions being

raised. reporter: brian, this is a project that's been happening in west portal since june 25th. it paused after a construction worker was killed but has since resumed normal operations. one thing that is different, though, around here is the construction company that's organizing things. shimmick construction, the original company hired to seismically improve the tunnel, is no longer here. 51-year-old patrick ricketts was working with shimmick when he was hit by a steel beam on friday and died. san francisco supervisor normal yee represents -- norman ye. he said: legal documents show that shimmick checked "no" when asked by the sfmta if violation in the last decade but cal/osha said the company received major fines for safety violations including some in the serious and

willful categories. so we reached out to shimmick but did not hear back from them for a comment. meanwhile, cal/osha and sfpd are both investigating the death of the construction worker. jackie ward, kpix 5. president trump is yanking the security clearance of one of his most outspoken critics. as john schiumo reports, the white house is also reviewing a handful of other former national security intelligence officers. reporter: former cia director john brennan has been stripped of his security clearances by president trump. >> any benefits that senior officials might glean from consultations with mr. brennan are now outweighed by the risk posed by his erratic conduct and behavior. >> reporter: brennan is a vocal critic of the president. he responded on msnbc. >> i do believe that, um, mr. trump decided to take this action, as he's done with others, to try to intimidate and suppress any criticism of him or his administration. >> reporter: mr. trump has made his disdain for brennan clear. >> i have no confidence in a

have yanked brennan's clearance last week but that it was too hectic. he didn't elaborate although he said he would put a republican on the list "if i thought they were incompetent or crazy." a passenger plane is being quarantined in nashville. these are live images of the american airlines jet. in nashville it's 8:07. mike huckabee is on board the american airlines flight. he tweeted about the incident this morning. flight which was traveling from los angeles to nashville was detained on the runway after a passenger appeared to be sick on board. we are told a doctor is on the plane examining the patient. in other news this morning, crews are making slow, steady progress finding the mendocino complex wildfires, although the largest of the two fires is continues to grow. the smaller river fire is out. but there's just 67%

containment of the ranch fire. that one has burned more than 315,000 acres in mendocino, lake and colusa counties. cal fire considers the combined fires as the largest on record in the state. one firefighter died and the fires have destroyed 147 homes and 118 other buildings. more than 1,000 buildings are still considered threatened. the fires have been burning for almost 3 weeks. the west coast wildfires are creating smoke in much of the pacific northwest. here's a look at the air conditions in seattle. air quality alerts have been issued for cities in washington including walla walla, spokane and yakima. air quality is unhealthy for parts of oregon, as well. developing now, in italy, the prime minister is declaring a state of emergency following a deadly bridge collapse. at least 39 were killed in the italian port city of genoa. survivors of the disaster described the highway falling in front of them and the

welcome back on this thursday morning. federal investigators are looking into a close call at missouri airport. if you look closely, you can see a plane narrowly miss a van at springfield branson national airport seconds before take-off. three airport employees were inside the van at the time. nobody was injured. a 61-year-old man is in the hospital this morning after a violent shark attack on an east coast beach. it happened yesterday in cape cod, massachusetts, when the man was standing 30 feet offshore. some quick thinking nearby nursing school grads rushed to his aid and packed his wounds until paramedics arrived. >> like, all right, he is breathing, he is conscious. let's stop this bleeding. we are, like, let's get him in this towel. a bunch of people carried him down. >> the beach was closed. no word on the condition of the victim this morning. raging floodwaters trapped residents in several feet of water in upstate new york yesterday after a predawn

storm pounded the area. water ripped through homes and roads causing damage. cuomo declared a state of emergency for more than a dozen counties in the finger lakes region and along the pennsylvania border. in spite of the damage, officials say nobody was hurt. >> they have several more days of rain on the way. so a storm system, they already had one coming through and the next one is coming through now. more rain to add on to that. for us no rain. we are desperate. >> 223 days. >> 123 days. >> it's been 100 years since it's rained! ha ha! >> are you making things up? >> 123 days of no rain in san jose in case you guys are keeping track with us. ha ha! here's a look from the "salesforce tower" camera. you can see clouds. yes, we have had about 100 days in a row of cloud coverage in the morning. that's what we have also been seeing across san francisco. but this is a good sign. we are already seeing a break

in the cloud coverage even in the early-morning hours. so this is our kpix 5 roof camera. it's always nice when you can see the buildings downtown. 57 in downtown san francisco. san jose 62. santa rosa now at 56 degrees. here's a look at your satellite/radar showing the cloud coverage as extending towards livermore, concord though starting to clear up a little bit. same with parts of redwood city. so not widespread cloud coverage like yesterday. and a lot of this is going to break off early this morning. so that means you will see more sunshine. that also means it will be a little warmer out there today. here's a look at your visibility down to six miles at half moon bay. livermore down to 7. concord 9. not bad at all for drivers commuting. usually when it's down to one or two miles, it could be rough to drive through. 10 a.m. sunshine for most of you. francisco, the golden gate bridge. but then it should burn off this afternoon making for

another pretty nice afternoon. yesterday sunshine at lunch. it will feel warmer especially for inland communities. you may not see that near the water. temperatures will be consistently cooler because of the overall west wind yet again. so the onshore breeze of course bringing in that coastal cool air that we see definitely around the water. but inland communities not impacted so much by that today. air quality is good so we are in the green which means skies should be clear. not affected by the wildfires. this ridge of high pressure is moving closer. so we are going to be getting warmer. today temperatures 83 palo alto, 82 sunnyvale. so instead of the 70s like you saw yesterday, reaching mostly the 80s for a lot of you and maybe some of the hottest spots at 90 like brentwood. 60s at the and 70s in the bay. wine country in the 80s. tomorrow not so comfortable. 90s through wednesday.

just going to see a few degrees increased. right now, we are tracking a major bart delay systemwide major delays due to an equipment problem on the tracks that originated in downtown oakland. now we're following this right now -- at one point it was 20- minute delays and they went to major delays. so if you usually take bart, you may want to reconsider that this morning because it's dealing with some major issues right now. so we'll keep you posted as to when they get back on track. but in the meantime, expect your morning commute to be pretty slow if you use bart. right now we are tracking an easy ride for drivers on the roads. there's 880 through oakland. and no delays along the nimitz freeway. if you are making your way southbound, this is just south of hesperian.

an easy commute towards the dumbarton bridge. we are starting to get busy but our drive times are in the green. san mateo bridge not a problem in either direction. a quick easy 13 minutes between 880 and 101. speaking of 101, here's a live look through san mateo near hillsdale boulevard. traffic moving right at the limit and quite a bit of space between all those cars out there. that's a check of traffic. back over to you. the department of homeland security's inspector general will review a tsa program called quiet skies. the program uses federal air marshals to track u.s. citizens flagged as possibly posing a threat. the passengers are not suspected of a crime and not under investigation and not on any terror watch list. investigators will look into whether the program follows privacy laws and whether it's effective. the dhs inspector general's announcement of the review of the program came in response to a request by congressman michael caputo. trying to address

struggles. that story and more business news from diane king hall of "cbsmoneywatch." >> reporter: worries about global economic growth particularly the economy in china along with pain in the retail sector sent stocks lower. the dow lost 137 and the nasdaq down 96. macy's still hasn't mastered a plan to keep shoppers in its stores. the department store chain says a key sales figure only inched up a .5% during its latest quarter. macy's has worked to reconfigure itself closing stores and allowing shoppers to check tout on their smartphones -- check out on their smartphones. profit was up $266 million, but stock was down almost 16%. it took other retailers with it. uber's net sales grew 63% in the second quarter but it's still struggling to make money. sales for the ride hailing app

bart. so right now, this is originating out of downtown oakland. bart single-tracking trains between bay fair and hayward due to a mechanical problem on the track. there was a crack reported on that track so single-tracking. give yourself some extra time. plan accordingly. we'll keep you updated as to when we get back on time. so this is definitely going to impact anyone who uses bart this morning. many, many riders. we'll take it out to the roads and do a quick check. here's 205. it's crawling westbound. we are tracking over 30 minutes just to go from i-5 over towards 580. so heading out of lathrop on into tracy, the ride is sluggish through the altamont pass into livermore. we are in the yellow tracking a travel time about 30 minutes towards 680. the bay bridge comes in and out of this view but this is our "salesforce tower" camera facing east so it was clear just moments ago.

now it's cloudy. that's kind of the story throughout the morning. it's not necessarily as widespread cloud coverage as we are used to seeing the past few weeks or past few days actually weeks i should say. here's a live look at the golden gate bridge with fog there. it looks like overall, our temperatures are going to be warming up today. cloud coverage clears early this morning. tomorrower though, the heat returns with a minimal onshore breeze. light variable breezes. east bay not as breezy as yesterday, vallejo 7, concord 13. fairfield only 14-mile-per- hour sustained winds. we have seen that a lot stronger across the hills especially. and north bay very calm conditions. that's why a lot of this fog is settling in across santa rosa so visibility may be lower there but overall the cloud coverage is breaking apart here and there already

for the early-morning hours. visibility not bad in the area. investigators say a driver's cell phone use was likely a factor in a crash that killed a chp officer and another man in fairfield. anne makovec joins us now with the charges the suspect faces in court today. reporter: two counts of vehicular manslaughter, gross vehicular manslaughter. that's what shawn walker is facing. he is a 36-year-old man from rocklin in placer county and will be in court for the first time today. officers believe walker was driving recklessly, speeding and was distracted by his phone. the crash happened friday morning in fairfield killing a california highway patrol motorcycle officer, kirk griess, and a man he had pulled over, jamie manuel. the two were on the side of i- 80 near manuel campos parkway

and officers say walker's pickup truck veered off the highway and hit them. officer griess was 46, a 19- year veteran of the chp. he is a former u.s. marine and leaves behind a wife and three children. manuel was 48. we have been hearing from some of his friends about the kind of man he was. >> very tough, really. i'm choking now. i -- yeah, it's been very hard. it's been very difficult for me. it's been very difficult for, you know, for the wife and children. >> ricky says jaime nicknamed jim was his best friend for a decade. they were roommates. jim was a care taker who had worked hard to put his daughter through college in the philippines. ricky says his only consolation now is that walker is behind bars. walker was sent to the hospital right after the crash and was released over the weekend. he is set to be arraigned at 1:30 this afternoon in solano county superior court in fairfield. >> anne makovec, thank you. a deadly accident in the

twin peaks tunnel is raising new concerns this morning after one contractor's true safety record may have slipped through the cracks. kpix 5's jackie ward is in san francisco with the troubling new accusations. reporter: good morning. that construction company has long gone from west portal. now a supervisor in san francisco is calling for a hearing to learn more about the process in which the city chooses these construction companies. shimmick construction had been working here on the twin peaks tunnel trying to make it safer since june 25th. but on friday, one of their own, 51-year-old patrick ricketts, died after being hit by a steel beam. it turns out according to cal/osha, shimmick lied to the sfmta when asked about having any serious or willful safety violations. the sfmta says that if they had told the truth shimmick would have been disqualified for the job. supervisor jane kim is on the transportation committee. >> this particular contract does highlight the need for us

to do a little bit more homework before we spend huge amounts of taxpayer dollars. >> reporter: supervisor norman yee represents this district and is calling for a hearing into how the city hires construction companies. in a statement he said, quote, we must make every effort to fully vet our contractors and ensure we are only contracting with companies that are forthright about their safety record. we reached out to shimmick for a comment on this situation but they have not gotten back to us. cal/osha and the sfpd are still investigating the death of the worker. the work here in west portal is still expected to be done by the end of the month. in san francisco, jackie ward, kpix 5. former san jose police chief larry esquivel has been hired as head of police in tracy. he spent 30 years with sjpd and was chief for two years. he joined the tracy police department in 2016. tracy officials confirm he was fired yesterday but wouldn't

say why saying it was a personnel matter. the tracy police officer's association says it supports him and is extremely disappointed in the firing. well, law enforcement leaders want lawmakers to know what it takes to pull the trigger before they vote on a bill to change the standard for police use of force from reasonable to necessary. yesterday, at the state capitol building, a simulator was set up by california chiefs of police so that lawmakers can see what it's like to be confronted in life and death scenarios. bill ab931 would put strict new limits on when officers could use deadly force and would change the legal standard by which california officers are judged. >> ab931 would take a very dynamic rapidly unfolding situation and evaluate that incident from the benefit of the 20/20 hindsight which is clearly -- officers don't have that luxury in that instan stain just decision.

>> it would force them to see nondeadly alternatives. the bill will be discussed at the state capital this morning. on the fire watch now, an intest deadly "firenado" in read -- an intense deadly "firenado" in redding last month as the carr fire burned. the firefighter who died on july 26th was killed by the "firenado." the "chronicle" obtained a report that says the "firenado" was the size of three football fields with winds up to 165 miles an hour. it swept down on jeremy stoke in seconds as he was trying to evacuate residents. an emotional sendoff for a utah firefighter killed battling california's largest wildfire. a procession was held for battalion chief matthew burchette. he was escorted from ukiah to the sonoma county airport in santa rosa. that's where fellow firefighters paid their final respects to the 42-year-old. the veteran firefighter died monday after a tree fell on him when he was fighting that huge ranch fire in lake

county. a tragic end to a missing persons case in colorado as a man confessed to murdering his wife and two young daughters. john schiumo is following the investigation. reporter: their disappearance shocked family, friends and neighbors in a quiet colorado town. 15 weeks pregnant and her two young daughters, three people missing without a trace early monday morning. christopher watts made an emotional appeal for his family's return. >> if somebody has her, just please bring her back. i need to see everybody. i need to see everybody again. this house is not complete without anybody here. >> reporter: but the investigation led police to christopher. the husband and father arrested late wednesday. cbs 4 in denver received a statement from the woman's family thread, it is with deep hurt, confusion and anger to confirm our beautiful cousin, unborn child and two daughters were viciously murdered by her

husband who confessed to the killings. police haven't confirmed that confession, nor have they released any information on the whereabouts or conditions of the missing wife or daughters. police say watts is being held at the weld county jail no charges yet filed. john schiumo, cbs news. >> police in frederick have scheduled a news conference on the case later today. a refugee from iraq is in custody accused of killing an iraqi policeman while fighting for the "islamic state" organization. the joint terrorism task force arrested omar abdulsattar ameen yesterday at a sacramento county airport -- i'm sorry, at a sacramento county apartment building where he lived. according to court documents he and other members of isis killed the officer after the iraqi town fell to the "islamic state" in 2014. some sacramento county neighbors are stunned. >> makes me nervous. yeah. we were shocked. >> u.s. officials plan to extradite ameen back to iraq

under a treaty with that country he could potentially face execution for an organized killing by an armed group. the uk is considering banning cars outside the houses of parliament after the alleged terror attack this week. three people were injured on tuesday when a man drove into a group of cyclists and crashed into barriers at parliament. the victims had nonlife- threatening injuries. the driver was arrested shortly thereafter. in lieu of other attacks in the country, officials have stepped up security and some say a car ban in parts of westminster could be the next step. president trump's legal team is preparing to go all the way to the supreme court if special counsel robert mueller mueller's subpoena asks an interview. he sought an interview with the president for months and reportedly threatened to subpoena mr. trump. according to the hill, the president's legal team has previously asserted that mr. trump would not have to comply

with a subpoena. meanwhile, president trump's lawyer says that he still has not received a response from mueller's team after president trump's attorney sent a letter on terms for an interview with the president. 12 jurors in alexandria, virginia, begin deliberations today in the bank and tax fraud trial of paul manafort. both sides presented closing arguments yesterday. prosecutors said president trump's former campaign chairman hid at least $16 million from the irs and lied to secure millions in bank loans. defense attorneys sought to tarnish the reputation. government's former business association rick gates. dominic caserta will not be charged after being accused ofs there was st. insufficnt evidence to prute. > a crime.it's deplorable for our

metro area in the nation to use bode scanners on public transit passengers. the question in the bay area is, will bart follow l.a.'s lead? they are being used in a partnership with the transportation security administration. the machines are designed to scan people for weapons and improvised explosive devices. >> it's none intrusive, not -- not intrusive, not showing body parts. >> bart has already introduced some ideas to make the rail system safe. some of the proposed measures have been criticized as potential invasions of privacy. new numbers out show that pot taxes are picking up in california. but they are still far off target. the "associated press" reports marijuana tax collections hit $48 million between april and june. finance officials estimated that california would bank $185 million in the first six

months of the year. but by june, collections have only hit 82. lawmakers are tackling long wait times at the dmv. in a 15-10 vote lawmakers narrowly approved a budget bill that will allow the dmv to pursue an additional $26 million to speed up the processing of licenses at their offices. some republicans slammed the decision saying the dmv has been unable to explain what they will do with millions they have already received. the average wait time at the dmv is now a little over an hour and a half. anyone who had to wait knows those long, long lines -- >> some people have had to wait all day and lining up at sunrise even with an appointment. >> speaking of standing and watching, there's a lot of waiting around this morning. >> we have big lines developing at the bart stations due to a problem they are trying to arrest

systemwide major delays. mechanical problem in downtown oakland, also between bay fair and hayward they are single- tracking now due to a cracked rail on the fremont line. so this is causing delays for all bart riders systemwide so heads up if you take mass transit or you know someone who does. give them a heads up towards the bart stations this morning. over at the bay bridge toll plaza, we have the metering lights on. the backup continues to stretch to the foot of the maze and beyond. we are in the yellow closer to 20 minutes heading into san francisco from the maze. here's the golden gate bridge foggy out there, traffic is moving at the limit, no accidents or stalls. neda has the forecast. i keep hoping for a view from our "salesforce tower" camera. now we got a sliver of blue. look at the top of your screen. hey, that's something.

fremont 5. pleasanton 5. breezier east of livermore. llow aitbreezybarely a breeze in the north bay and that's where some of the cloud coverage is settling this morning. visibility somewhat low, not too bad though. futurecast showing by 11:00, though, a lot of you will be sitting pretty under blue skies, sunshine, air quality today good. the marine layer will be back tonight. it won't be as widespread according to this futurecast. but tomorrow morning we are going to have that onshore breeze again but a lot lighter and so that means temperatures will be warmer so many today, low 60s at the beaches. 82 in sunnyvale. 84 campbell. these numbers a little higher than yesterday so we are slowly inching our way up. 73 mountain view. 74 in fremont. 90 possible for brentwood. 88 in antioch. 84 in danville. san ramon 83. right around the bay sausalito, san francisco, mid- 60s. alameda 69. berkeley 68. so overall should be comfortable especially when that sun comes out. should be overall nice. lakeport and clearlake still in the 90s, though, again.
